Fifth Circ. Revives Union Pacific Land Rights Case

Law360, New York (November 4, 2011, 5:46 PM EDT) -- The Fifth Circuit on Thursday shot down a ruling in favor of a group of landowners in a dispute with Union Pacific Railroad Co. over its right to close railroad crossings, saying the district court must determine the rights to the land in question.

The Fifth Circuit vacated a district court ruling that said Union Pacific no longer had standing to pursue its legal attempt to close the crossings because of a recently passed Louisiana law that requires railroad companies to get state approval before shutting down a crossing.
