Law360, New York (November 04, 2011, 1:42 PM ET) -- Acella Pharmaceuticals LLC on Thursday knocked out a patent suit brought by Medicis Pharmaceutical Corp. over benzoyl peroxide foaming cloths used to treat acne, when an Arizona federal judge ruled the patent asserted by Medicis was invalid.
U.S. District Judge James Teilborg granted Acella's Sept. 2 motion for summary judgment, and held that all the asserted claims of Medicis' patent, which covers a drug delivery system made up of a pad, a container and a liquid composition with dermatologically active ingredients, were invalid for obviousness....
