Law360, New York (November 07, 2011, 5:38 PM ET) -- The Ninth Circuit on Monday tossed the remaining claims in a suit brought by the former general counsel of McAfee Inc. alleging the software maker made him the fall guy in a criminal and civil stock options backdating probe.
The appeals court affirmed a lower court's decision to dismiss Kent Roberts' defamation and invasion of privacy claims, and reversed its decision to allow malicious prosecution claims, ruling that the company's suspicion of Roberts was not unreasonable.
