Law360, New York (November 08, 2011, 8:19 PM ET) -- A class of roughly 200,000 BMW of North America LLC customers on Tuesday won preliminary approval of a proposed settlement of their accusations that the carmaker altered vehicle software to hide potentially serious engine malfunctions.
U.S. District Judge Susan Illston said that the terms of an Oct. 6 proposed settlement agreement were “sufficiently fair, reasonable and adequate,” clarifying that though it was not a final decision, the proposed settlement could proceed to a hearing for final approval.
