EU, Members Agree On Merger Antitrust Review Guide

Law360, New York (November 9, 2011, 6:50 PM EST) -- The European Union and its members on Wednesday finalized guidelines for how individual countries' competition regulators should work together when examining mergers that don't merit EU-wide reviews in order to speed investigations and avoid conflicting decisions.

The final version of the best practices largely mirrors proposals a European Commission working group put out in late April, though it includes stronger language about how the national watchdogs should share information through an EU-wide antitrust notice system and offers further counsel to merging parties about signing confidentiality waivers...
