UPS Store Owners Ask 9th Circ. To Revive Contract Suit

Law360, Los Angeles (November 9, 2011, 8:22 PM EST) -- An attorney representing more than 200 UPS Store franchisees told the Ninth Circuit Wednesday that a lower court had erred in throwing out claims that UPS Inc. and subsidiary Mail Boxes Etc. Inc. breached contracts and duped investors into opening franchises that were consistently unprofitable.

“Plaintiff franchisees brought 14 claims for relief,” plaintiffs’ attorney L. Michael Hankes told the Ninth Circuit panel. “The district court wrongly dismissed not one or two claims, but rather all 14 claims.”
