Fed Circ. Backs DuPont's Semiconductor IP Win

Law360, New York (November 14, 2011, 10:08 PM EST) -- The Federal Circuit on Monday upheld a jury verdict of noninfringement in DuPont Air Products NanoMaterials LLC's suit against Cabot Microelectronics Corp. over patents for tungsten chemical mechanical planarization, a process used in semiconductor manufacturing.

While a District of Arizona jury in July 2010 rejected DuPont's claims that the patents in suit — 5,958,288; 5,980,775; 5,527,423; and 6,068,787 — were invalid and the '775, '787 and '288 patents were unenforceable, it granted DuPont a declaratory judgment that it had not infringed the patents.
