Town Can Trim Firefighter Positions: NY High Court

Law360, New York (November 17, 2011, 3:08 PM EST) -- The New York Court of Appeals on Thursday reversed a lower court’s granting of arbitration for a firefighters union that alleged the village of Johnson City violated the terms of a labor agreement by terminating six firefighters in response to budget cutbacks.

In a 4-3 decision, the Court of Appeals determined that the language of a no-layoff clause in the collective bargaining agreement between Johnson City and the Johnson City Firefighters Association didn’t explicitly preclude the city from cutting firefighters “out of budgetary necessity.”
