Kan. Judge Hands Insurance Row Reins To Mo. State Court

Law360, New York (November 18, 2011, 5:01 PM EST) -- A Kansas federal judge on Thursday declined to restart insurer Mid-Continent Casualty Co.'s lawsuit seeking to avoid covering a developer in an underlying suit over allegedly defective townhouses, instead deferring to a Missouri state court.

At the request of insured Greater Midwest Builders Ltd. and the homeowners' association that brought the underlying suit in Kansas state court, the federal court in October 2009 stayed the insurer's declaratory judgment suit until the conclusion of the dispute over GMB's allegedly negligent construction of a subdivision.
