Law360, Los Angeles (November 17, 2011, 9:24 PM ET) -- A California federal judge on Thursday raised concerns that testimony from a damages expert for Pom Wonderful LLC may have been prejudicial to Ocean Spray Cranberries Inc. during the third day of the juice rivals' false advertising trial.
U.S. District Judge Dean D. Pregerson questioned the testimony of Vanessa J. Hill who told jurors that Ocean Spray's allegedly deceptive labeling on its cranberry-pomegranate juice drink had cost Pom approximately $33.1 million in lost earnings, adding that Hill's figure would be stricken from the record.
