Law360, New York (November 18, 2011, 6:39 PM ET) -- A New Jersey state court ruled Friday that New Jersey punitive damages law applies in a product liability case against Novartis Pharmaceutical Corp. over the bone drug Zometa, a decision that could exclude punitive damages in the case.
The plaintiff, Charles Irby of Virginia, claims that Zometa caused him to develop osteonecrosis — also known as “bone death” — of the jaw. Novartis has been fighting hundreds of similar cases over Zometa and another medication, Aredia, in state and federal courts.
