Darvocet, Darvon Suits Must Be Nixed After Mensing: Lilly

Law360, New York (November 22, 2011, 3:56 PM ET) -- Eli Lilly & Co. asked a Kentucky federal judge Tuesday to dismiss 22 consolidated suits claiming it hid health risks tied to painkillers Darvocet and Darvon, saying consumers' claims are preempted in light of the U.S. Supreme Court's ruling in Pliva v. Mensing.

Consumers' suits, which were consolidated into multidistrict litigation in August, allege Lilly, Xanodyne Pharmaceuticals Inc. and their affiliates and distributors failed to address cardiac risks tied to the drugs, which contain propoxyphene.
