Kaplan Again Beats Ex-Employees' Claims In FCA Suit

Law360, New York (November 23, 2011, 6:04 PM ET) -- Two ex-Kaplan University employees on Monday failed in their bid to revive claims in a False Claims Act suit in Florida accusing Kaplan of fraudulently obtaining billions of dollars in federal funds by lying about its compliance with the Higher Education Act.

Relators Ben Wilcox, a former dean of paralegal studies at Kaplan University, and Carlos Urquilla-Diaz, a former instructor at Kaplan, asked a Florida federal judge to salvage their allegations that Kaplan had falsely certified that it had not provided incentive payments to student recruiters...
