Law360, New York (November 28, 2011, 3:30 PM ET) -- A California federal judge on Wednesday denied software company Citrix Systems Inc.’s bid to dismiss an engineer’s proposed overtime class action against it, roundly rejecting Citrix’s assertions that the plaintiff had failed to state a claim.
U.S. District Judge David O. Carter took Citrix to task in his order, writing that the company's argument that plaintiff Yuckming Chiu failed to state a claim are "simply wrong on the law."
