Hawaii Hotel Asks High Court To Review NLRB Pinch-Hitting

Law360, New York (November 28, 2011, 11:03 PM EST) -- The owners of Hawaii's Pacific Beach Hotel urged the U.S. Supreme Court to tackle whether the National Labor Relations Board’s decisions to allow its general counsel to pursue court injunctions remain valid if the board later falls to two members.

The Nov. 14 petition for certiorari asked the nation's highest court to review a July decision by the Ninth Circuit that had affirmed a federal court injunction requiring the hotel to bargain with its employees' union and reinstate discharged employees.
