Dean Antitrust Claims Skimmed From Distributor’s Suit

Law360, New York (November 29, 2011, 3:54 PM ET) -- A Wisconsin federal judge on Monday tossed most of a suit brought by an Illinois-based dairy distributor against milk products giant Dean Foods Co., finding little basis for the distributor’s antitrust claims.

U.S. Magistrate Judge Aaron E. Goodstein dismissed two antitrust claims brought by Fresh N’ Pure Distributors Inc. against Dean and Wisconsin cooperative association Foremost Farms USA, finding Dean’s alleged refusal to do business with Fresh N’ Pure did not violate the Robinson-Patman Act, according to the order to dismiss.
