Ledbetter Can't Save Age Bias Suit: 10th Circ.

Law360, Los Angeles (November 29, 2011, 6:43 PM EST) -- The Tenth Circuit on Tuesday affirmed a lower court's dismissal of an age discrimination lawsuit brought by two Kansas public school employees who were relegated to lower-paying positions during budget cuts, saying the Lilly Ledbetter Fair Pay Act — which eliminates the statute of limitations on pay discrimination claims — doesn't apply.

The three-judge panel ruled that claims brought by maintenance workers Dwight Almond III and Kevin Weems were time-barred under the Age Discrimination Employment Act, upholding a Kansas federal judge's 2008 ruling.
