Law360, San Diego (December 01, 2011, 7:25 PM ET) -- A federal court in Washington state on Thursday shot down ABM Industries Inc.’s bid seeking to decertify a collective action by janitors who claim the cleaning services provider violated federal wage-and-hour laws by scrimping on overtime pay.
U.S. District Judge Ricardo Martinez found that although ABM identified several differences in the individual working conditions of the opt-in plaintiffs, those variations failed to show that the case should not be tried on a collective basis.
