9th Circ. Nixes Suit Claiming UPS Led Franchisees Astray

Law360, New York (December 2, 2011, 6:11 PM EST) -- The Ninth Circuit on Thursday affirmed a district court’s decision to toss claims by some 200 UPS Store franchisees accusing UPS Inc. and its subsidiary Mail Boxes Etc. Inc. of deceiving them into opening unprofitable franchises.

In a not-for-publication ruling, a three-judge panel affirmed U.S. District Judge Otis D. Wright’s March 2010 decision to dismiss the franchisees’ actions, after they failed to convince him that UPS had misled them into opening stores that faced economic risk, without giving them proper guidance on operating those stores....
