NLRA Doesn’t Preempt RI Hotel Worker Law: 1st Circ.

Law360, New York (December 02, 2011, 3:28 PM ET) -- The First Circuit ruled Friday that a Providence, R.I., law requiring new hospitality employers to retain their predecessor's employees for three months is not preempted by the National Labor Relations Act, rejecting the Rhode Island Hospitality Association's challenge to the city ordinance.

The appeals court affirmed a district court's decision to toss a lawsuit brought by the trade association, as well as the companies that run the Hilton Providence and the Westin Providence, seeking to block the enforcement of the ordinance.
