Drake Beam Consultants Win Conditional Cert. In OT Case

Law360, San Diego (December 06, 2011, 8:11 PM ET) -- A Colorado federal judge on Tuesday conditionally certified a collective action brought by hourly nonexempt consultants for Drake Beam Morin Inc. who claim the human resources services company refused to pay them overtime.

U.S. District Judge Robert Blackburn concluded that the plaintiffs had met the burden to conditionally certify a class under the Fair Labor Standards Act by alleging that DBM willfully failed to compensate its consultants for working a substantial amount of regular and overtime hours.
