Judge Won't Oust Non-Mich. Plaintiffs In OnStar Analog MDL

Law360, New York (December 08, 2011, 4:54 PM ET) -- A Michigan federal judge on Wednesday refused to reconsider his decision allowing non-Michigan residents to pursue class action claims under a state consumer protection law in multidistrict litigation over the failure of analog telecommunication equipment used in OnStar LLC's safety systems.

In the contested decision, U.S. District Judge Sean Cox held that the Michigan Consumer Protection Act limitation on class actions conflicted with Rule 23 of the Federal Rules of Civil Procedure and therefore did not prevent nonresidents from pursuing a class action under the MCPA...
