Law360, New York (December 08, 2011, 8:39 PM ET) -- A federal judge on Wednesday rejected a request by Patriot Coal Corp. and three subsidiaries to throw out a citizen environmental suit alleging the companies dumped illegal amounts of selenium into waters near mining sites in West Virginia.
U.S. District Judge Robert Chambers denied a motion by Patriot Coal and the three subsidiaries to dismiss the suit, ruling that the plaintiffs — a trio of environmental organizations — had standing to pursue their claims.
