Law360, New York (December 08, 2011, 8:34 PM ET) -- Oracle America Inc. said Wednesday that the U.S. Patent and Trademark Office has nixed a patent claim from its suit against Google Inc., dealing the software company a potential setback in its fight over Google’s Android operating system.
The USPTO rejected the asserted claims of one of the patents-in-suit, U.S. Patent Number 7,426,720, in light of the proffered prior art, according to the supplemental joint pretrial conference statement. Oracle said it is seeking reconsideration of the USPTO's action.
