Dairy Farmers Lose Cert. Bid In Milk Antitrust Action

Law360, New York (December 09, 2011, 4:19 PM ET) -- A Vermont federal judge on Friday refused to certify a class action accusing Dairy Farmers of America Inc. and others of creating a milk monopsony in the Northeast, saying the dairy farmers failed to show commonality of their claims.

In U.S. District Judge Christina Reiss’ order denying without prejudice the dairy farmers’ motion to certify the class, the judge found the class at this point had not adequately shown the alleged conspiracy had common adverse impacts on farmers.
