Imperial Sugar Can't Move Explosion Coverage Suit

Law360, New York (December 09, 2011, 7:11 PM ET) -- A Georgia federal judge on Friday denied Imperial Sugar Co.'s bid to dismiss or transfer to Texas a suit brought by American Guarantee & Liability Insurance Co. disputing its obligation to defend Imperial in worker lawsuits over a 2008 sugar refinery explosion.

U.S. District Judge William S. Duffey Jr. denied Imperial's motion to dismiss the suit or, as an alternative, move it to Texas, finding that Imperial had failed to prove that American Guarantee filed its Georgia suit in anticipation of one lodged a day later...
