Law360, New York (December 09, 2011, 7:57 PM ET) -- Abercrombie & Fitch Stores Inc. asked the Tenth Circuit on Thursday to overturn a lower court's finding that the chain had discriminated against a Muslim woman by refusing to hire her because she wore a hijab.
Abercrombie claims U.S. District Judge Gregory K. Frizzell erred in granting summary judgment to the U.S. Equal Employment Opportunity Commission on liability because the woman had never informed the chain that she was a Muslim.
