No Harm, No Foul In Data Breach Suits: 3rd Circ.

Law360, New York (December 12, 2011, 4:19 PM EST) -- The Third Circuit affirmed Monday that two former Brach Eichler LLC employees could not bring a class action against payroll processing company Ceridian Corp. over a data breach because their claims the breach would harm them were too speculative.

The case centered on an unknown hacker's December 2009 breach of a Ceridian system containing the personal and financial information of about 27,000 employees at 1,900 companies, including Brach Eichler.
