HP Sales Reps Lose Class Cert. Bid In OT Suit

Law360, New York (December 12, 2011, 4:01 PM ET) -- An Idaho federal judge on Monday refused to certify a class action against Hewlett-Packard Co., saying the putative class of customer service representatives lacked sufficient evidence that the computer maker systematically required employees to work off the clock.

U.S. District Judge B. Lynn Winmill denied without prejudice lead plaintiff Karen Fenn's motion for conditional class certification, finding that Fenn had not sufficiently proven that her claims were similarly situated with others.
