BofA, Insurers Beat Customer Privacy Action In 5th Circ.

Law360, New York (December 13, 2011, 6:45 PM ET) -- The Fifth Circuit on Tuesday upheld a Texas federal court's dismissal of a putative nationwide privacy class action against Bank of America NA and its insurance services unit that alleged they illegally sold inferior insurance products to low-income, Spanish-speaking customers.

In its opinion, the three-judge panel modified the dismissal for one of the defendants, Loeb Holding Corp., to be without prejudice.

The plaintiff, Jorge Gonzalez, had accused Bank of America of identifying lower-income Spanish-speaking customers as potential targets and then conveying their information to Intersections Inc....
