No Dice On Casino Contract Breach Claims: 10th Circ.

Law360, New York (December 14, 2011, 7:43 PM ET) -- A Kansas gaming company did not breach a sale contract when it dropped plans to develop a casino on property it purchased for the project in the southeastern part of the state, the Tenth Circuit ruled Tuesday.

The appeals court said a Kansas federal judge made the right call when granting summary judgment to Kansas Penn Gaming LLC in a dispute over $37.5 million HV Properties of Kansas LLC claimed it was owed after Kansas Penn failed to see the casino project to completion.
