Law360, New York (December 15, 2011, 5:37 PM ET) -- The Second Circuit on Wednesday gave the U.S. Department of Labor permission to file a brief backing workers of The McGraw-Hill Cos. Inc. who are fighting to revive their lawsuit claiming their retirement plans were imprudently invested in company stock.
A three-judge panel granted the agency's request to file an amicus brief in support of the workers' petition for a rehearing on their appeal of the suit's dismissal. The department sought the court's permission to do so on Dec. 9.
