Builders Can't Fight Army Corps Ditch Rule: DC Circ.

Law360, New York (December 16, 2011, 9:22 PM EST) -- The D.C. Circuit on Friday tossed a housing developer group's Clean Water Act challenge to a nationwide discharge permit issued by the Army Corps of Engineers, saying the group lacked standing to bring the suit.

In 2007, as part of an effort to reduce red tape, the Corps issued a nationwide permit that allowed builders to discharge fill materials into nontidal upland ditches without needing to apply for an individual permit.
