API's Challenge To NC Renewable Fuel Law Tossed

Law360, New York (December 16, 2011, 7:42 PM ET) -- A North Carolina federal judge on Friday tossed the American Petroleum Institute’s claims that a North Carolina law requiring refiners and producers to sell wholesalers gasoline unblended with ethanol is preempted by federal renewable fuel and marketing laws.

U.S. District Judge Louise Flanagan shot down arguments by plaintiffs API and the National Petrochemical and Refiners Association, who filed suit when the law, billed the ethanol blending statute, was signed in August 2008. The judge held that the law does not interfere with federal statues.
