Nursing Home CEO Let Out Of Medicaid FCA Case

Law360, Washington (December 19, 2011, 6:30 PM EST) -- A Kentucky nursing home CEO on Monday won his bid to exit a $16 million False Claims Act suit alleging the home defrauded the Medicaid program, but the company remains on the hook.

U.S. District Judge Danny C. Reeves granted Villaspring Health Care Center Inc. CEO Barry N. Bortz's motion to be dismissed from the U.S. Department of Justice's case, which stems from allegations of severe neglect of residents at the home, but denied Villaspring's motion for the same.
