11th Circ. Lets Tyson Off Hook In Sexual Harassment Fight

Law360, New York (December 20, 2011, 7:56 PM EST) -- The Eleventh Circuit on Tuesday refused to revive a sexual harassment suit brought by a Tyson Foods Inc. technician against the poultry processor, saying the company had anti-harassment policies that the victim failed to take advantage of.

The appeals court affirmed an Alabama federal court’s decision to grant Tyson summary judgment on sexual harassment and retaliation claims brought by employee Deborah Leeth.
