Game Over For ‘Final Fantasy’ Subscription Row: 9th Circ.

Law360, Chicago (December 21, 2011, 2:26 PM EST) -- The Ninth Circuit refused Tuesday to revive a putative class action brought by "Final Fantasy XI Online" buyers alleging video game maker Square Enix Inc. never told them the game would become useless unless they paid monthly subscription fees.

In a three-page nonprecedential memorandum, the appeals court ruled that a lower court had properly dismissed the suit and that the game purchasers had failed to show they relied on Square Enix's alleged nondisclosure — that they would forfeit their online accounts and characters if they failed...
