Cipro Antitrust Case Goes To State Court

Law360, New York (July 16, 2007, 12:00 AM EDT) -- A class action accusing Bayer AG as well as several smaller pharmaceutical companies of antitrust violations on a national scale can proceed under Wisconsin state jurisdiction, the Supreme Court of Wisconsin ruled Friday.

The court upheld a 2006 Wisconsin appellate decision stating that the allegations can be adjudicated by state courts because the alleged conduct, though falling under interstate commerce, nonetheless “substantially affects” residents of Wisconsin.
