5th Circ. Reinstates Woodforest Bank Race Bias Suit

Law360, New York (December 22, 2011, 2:25 PM ET) -- The Fifth Circuit on Wednesday revived a lawsuit brought by the white former manager of a Woodforest Bank branch located in a Starkville, Miss., Wal-Mart store who claims she was fired because of her race.

The appeals court reversed a Mississippi federal court's grant of summary judgment to the bank, saying that Carol L. Vaughn had presented a genuine issue of material fact concerning whether Woodforest’s proffered reason for firing her was pretext for racial discrimination.
