Nintendo Mii Avatars Not Playing By IP Rules: Suit

Law360, New York (December 22, 2011, 5:41 PM EST) -- Nintendo Co. Ltd. and its U.S. unit were accused Tuesday of improperly bundling patent-protected image encryption software belonging to a patent holding company onto its popular Nintendo Wii entertainment system as part of its Mii character customization feature.

Texas-based RecogniCorp LLC launched the suit in Oregon federal court, claiming Nintendo's Wii game console contains image customization software used to create and customize facial features of Mii avatars in violation of U.S. Patent Number 8,005,303.
