Law360, New York (December 23, 2011, 4:27 PM ET) -- A federal judge ruled Thursday that two Idaho statutes expanding the state's right-to-work law for public works projects are preempted by the National Labor Relations Act.
Judge B. Lynn Winmill of the District of Idaho held that both Open Access to Work Act and the Fairness in Contracting Act would impermissibly restrict activity protected by the NLRA. He granted summary judgment to the Idaho Building and Construction Trades Council AFL-CIO, which challenged the provisions.
