Vitamin Shoppe, Managers Settle OT Pay Dispute

Law360, New York (January 03, 2012, 4:20 PM ET) -- Vitamin Shoppe Industries Inc. on Tuesday settled the remainder of a class action that accused the retail chain of calling its clerks “managers” to dodge overtime pay, after beating most of the suit at the class certification stage.

The health product chain has reached a settlement agreement with lead plaintiff Julio Vasquez, a former clerk titled “store manager” who claimed Vitamin Shoppe violated the Fair Labor Standards Act by shorting his and others' overtime pay, according to a stipulation filed in New York federal court....
