Cracker Barrel Seeks EEOC Suit Coverage In 6th Circ.

Law360, New York (January 04, 2012, 7:21 PM ET) -- Cracker Barrel Old Country Store Inc. on Tuesday urged the Sixth Circuit to overturn a finding that the restaurant chain's insurer is not obligated to pay defense costs stemming from a U.S. Equal Employment Opportunity Commission lawsuit.

In its brief, Cracker Barrel argued that a Tennessee district judge had been wrong to find that the EEOC's suit against it was not a covered claim under Cracker Barrel's policy with Cincinnati Insurance Co. because the suit had not been brought directly by an employee.
