Law360, New York (January 05, 2012, 8:46 PM ET) -- The Ninth Circuit on Thursday asked California's Supreme Court to weigh in on key issues in Sierra Pacific Power Co.'s suit seeking insurance coverage for the full $19.8 million cost of rebuilding a hydroelectric dam destroyed by a 1997 flood.
Sierra is appealing a lower court's finding that the actual cash value of the Farad Dam in California was only $1.2 million, in its suit seeking coverage from its insurers Hartford Steam Boiler Inspection and Insurance Co. and Zurich American Insurance Co.
