Nationwide Insurance Investigators Out Of Luck In OT Suit

Law360, New York (January 05, 2012, 6:20 PM ET) -- An Ohio federal judge sided with Nationwide Mutual Insurance Co. on Thursday in a collective action accusing the insurer of misclassifying its special investigators as exempt from overtime pay, ruling that the Fair Labor Standards Act's administrative exemption applied.

Following a trial in September, U.S. District Judge Edmund A. Sargus Jr. concluded that because the special investigators exercised discretion and independent judgment in their primary duty, their job fell within the administrative exemption to the FLSA's overtime pay requirements.
