High Court Rips EPA In Homeowners’ Wetlands Fight

Law360, New York (January 9, 2012, 7:27 PM EST) -- U.S. Supreme Court justices on Monday criticized the Environmental Protection Agency’s decision to deny an Idaho couple’s challenge to an order forcing them to halt development of land the agency deemed to be wetlands, during oral arguments in the couple’s suit over the matter.

The court’s conservatives grilled the EPA’s lawyer, Deputy Solicitor General Malcolm Stewart, over whether the agency could use a compliance order to bar the couple from building a house on the land and reject their request for a hearing to contest it....
