Rite Aid Overcharges Drug Discount Plan Members: Suit

Law360, New York (January 06, 2012, 6:12 PM ET) -- Rite Aid Corp. was hit with a putative class action Friday in New York federal court that accuses the drugstore chain of overcharging thousands of members enrolled in its generic prescription drug discount program.

The suit, which asserts breach of contract, unjust enrichment and New York state business law violation claims, alleges members of Rite Aid's Rx Savings Program who pay for their generic prescription drugs using health insurance are automatically charged their applicable insurance copayment without their knowledge, rather than the Rx Savings Program price....
