High Court Review Sought In Suit Over Army Chopper Crash

Law360, New York (January 6, 2012, 8:32 PM EST) -- The families of soldiers killed in a 2007 helicopter crash in Afghanistan petitioned the U.S. Supreme Court late last month to review the Ninth Circuit's ruling that Boeing Co. and other government contractors were not liable for the crash.

The families argue that the Ninth Circuit erred in its August decision when it held that the plaintiffs' design defect claims were preempted by the government contract defense established in the high court's 1988 case, Boyle v. United Technologies Corp.
