Law360, New York (January 09, 2012, 5:28 PM ET) -- A California federal judge on Monday denied Conceptus Inc.’s bid for a permanent injunction against women’s health technology firm Hologic Inc. from selling a birth control device that violated a patent covering permanent, noninvasive contraceptive systems.
U.S. District Judge William Alsup said that although Conceptus — whose only product is its Essure contraceptive system — had lost customers and market share to Hologic’s competing Adiana system that violated its patent, the jury’s $18.8 lost profits award to the plaintiff in October adequately compensated it.
