Law360, New York (January 10, 2012, 5:12 PM ET) -- The Federal Circuit on Tuesday again affirmed a ruling in favor of Streck Inc. in its ongoing intellectual property battle with Research and Diagnostic Systems Inc. over the rights to technology covering hematology control products.
Despite losing an appeal in the same court in October, R&D brought another appeal, arguing against the dismissal of R&D’s invalidity counterclaims and the granting of summary judgment for Streck on the matter of written description, according to the opinion.
